An IEE is a comprehensive evaluation conducted by a qualified examiner who is not employed by the school district. Parents have the right to request an IEE at public expense if they disagree with the school's evaluation under IDEA (Individuals with Disabilities Education Act).
If you disagree with the school's evaluation, you can request an IEE at public expense. The district must either agree to fund it or file for a due process hearing to defend their evaluation. You can also obtain a private IEE at your own expense at any time.
A comprehensive IEE typically takes 4-6 weeks from initial records review through completion of the written report. Testing sessions are scheduled over 2-3 appointments to avoid fatigue and ensure accurate results.
The school district must consider the IEE results when making educational decisions. You can present the report at an IEP meeting, and the evaluator can attend to explain findings and recommendations. The district doesn't have to implement all recommendations but must consider them.
The school can refuse by filing for due process hearing to defend their evaluation. However, most districts agree to fund IEEs rather than pursue costly hearings. If they file for hearing and lose, they must pay for the IEE plus potentially your attorney fees.
