Your Rights Under IDEA

Federal law protects your right to an independent evaluation when you disagree with the school district's findings.

Independent Educational Evaluation at Public Expense

Under the Individuals with Disabilities Education Act (IDEA), parents have the right to obtain an Independent Educational Evaluation (IEE) if they disagree with an evaluation conducted by the school district. The district must either fund the independent evaluation or file for a due process hearing to demonstrate that its own evaluation was appropriate.

You are entitled to one IEE at public expense each time the district conducts an evaluation with which you disagree. The IEE must be considered by the school district in any decision regarding your child's educational services.

The IEE Process
